Welcome to Geotech Buildcon Pvt Ltd. By engaging with our geotechnical and environmental engineering services, you agree to the following terms and conditions.
1. Service Overview
- We specialize in geotechnical and environmental engineering projects including rockfall protection, slope stabilization & erosion control, reinforced earth walls (RE walls), and landfill & lining solutions.
- All services are executed with state-of-the-art technology and equipment, ensuring precision and efficiency in every project.
- Custom solutions are developed based on site-specific requirements and comprehensive geotechnical assessments.
- We provide end-to-end project execution from design and engineering to installation and commissioning.
2. Project Engagement & Contracts
- All projects require a signed agreement outlining scope of work, technical specifications, timeline, and commercial terms.
- Site surveys and geotechnical assessments are mandatory before project commencement to ensure optimal solution design.
- Any variations to the original scope must be approved in writing and may result in timeline and cost adjustments.
- Client must provide necessary site access, utilities, permits, and regulatory clearances as per agreed timeline.
3. Payment Terms
- Standard payment terms: 30% advance upon agreement signing, progress payments based on project milestones, 10% retention released after successful completion.
- All quoted prices exclude applicable GST, permits, third-party approvals, and transportation charges unless specified otherwise.
- Late payment charges at 18% per annum will apply on overdue amounts beyond 30 days from due date.
- Price escalation may apply for projects extending beyond agreed timelines due to client-induced delays or scope changes.
4. Safety & Compliance
- All work is executed following stringent safety protocols, industry standards, and environmental regulations.
- Client must ensure site safety compliance and provide necessary safety briefings for site-specific hazards and restrictions.
- Geotech Buildcon Pvt Ltd maintains comprehensive insurance coverage for all project activities and workforce.
- Any accidents or incidents due to client negligence or non-compliance with agreed safety protocols remain client's responsibility.
5. Quality Assurance & Materials
- All materials including HDPE geomembranes, high-energy barriers, mesh systems, and earth reinforcement materials undergo rigorous quality checks.
- Quality certificates, test reports, and compliance documentation provided upon project completion.
- Third-party testing and certification arranged where required by project specifications or regulations.
- Client inspection and approval required at critical project milestones before proceeding to next phase.
6. Project Timeline & Environmental Factors
- Project timelines are indicative and subject to weather conditions, monsoon seasons, regulatory approvals, and site accessibility.
- Force majeure events including natural disasters, strikes, government actions, or pandemic restrictions may extend project timelines.
- Client-induced delays including late approvals, site access issues, design changes, or permit delays may result in cost escalations.
- Extension of time will be granted for delays beyond Geotech Buildcon Pvt Ltd's reasonable control.
7. Warranty & Performance Guarantee
- Comprehensive warranty covering workmanship and material defects for 12-24 months depending on project type and complexity.
- Warranty excludes damage due to natural wear, misuse, unauthorized modifications, extreme weather events, or acts of nature.
- Annual maintenance contracts available for complex installations like rockfall protection systems and slope stabilization works.
- Emergency response support available through our 24/7 helpline for critical infrastructure projects.
8. Environmental Responsibility & Sustainability
Geotech Buildcon Pvt Ltd is committed to sustainable engineering practices and environmental protection. All projects incorporate eco-friendly solutions including native vegetation techniques, hydroseeding, biodegradable erosion control materials, and methodologies that minimize environmental impact while ensuring long-term stability and safety.
9. Technical Specifications & Standards
- All installations comply with relevant Indian Standards (IS codes), international best practices, and project-specific requirements.
- Mechanically Stabilized Earth (MSE) walls, rockfall barriers, and lining systems designed as per approved engineering calculations.
- Geotechnical parameters and design assumptions clearly documented and approved before execution.
- Any deviations from approved technical specifications require written approval and may affect warranty terms.
10. Intellectual Property & Confidentiality
- All proprietary designs, technical solutions, installation methodologies, and engineering calculations remain property of Geotech Buildcon Pvt Ltd.
- Client project details, site conditions, and technical specifications are treated with strict confidentiality.
- Use of project photographs, case studies, and technical data for marketing purposes requires explicit client consent.
- Reverse engineering, replication, or unauthorized distribution of our proprietary solutions is strictly prohibited.
11. Limitation of Liability
Geotech Buildcon Pvt Ltd's liability is limited to the total contract value. We shall not be liable for indirect, consequential, punitive damages, or loss of profits. Our obligation is limited to repair, replacement, or refund of services rendered. Liability for third-party claims is excluded except where caused by our negligence.
12. Dispute Resolution & Governing Law
- All disputes shall first be addressed through mutual discussion, site meetings, and mediation.
- Unresolved disputes will be subject to arbitration under Indian Arbitration and Conciliation Act, 2015.
- Jurisdiction for all legal matters shall be courts in the state where Geotech Buildcon Pvt Ltd's registered office is located.
- This agreement shall be governed by Indian laws, regulations, and industry standards.
13. Termination & Project Closure
- Either party may terminate the agreement with 30 days written notice for convenience, subject to completion of ongoing critical phases.
- Immediate termination allowed for material breach, insolvency, repeated safety violations, or non-payment.
- Upon termination, client shall pay for all work completed, materials procured, and demobilization costs.
- All confidentiality, intellectual property, and warranty clauses survive agreement termination.
